TERMS OF SERVICE

1. The Agreement

These Terms of Service ("Terms") govern your access to and use of https://shopplaytime.com/ (the "Site"), operated by PLAYTIME LLC ("PLAYTIME", "we", "us", "our"), 342 West Madison Street, Suite 800, Chicago, IL 60606, United States, EIN 47-3821654, as well as every purchase made through the Site.

By accessing the Site or placing an order, you confirm that you are at least 18 years old, or the age of majority in your state of residence, and that you accept these Terms in full, together with our Terms and Conditions of Sale, Privacy Policy, Refund Policy, Shipping Policy, and Cookie Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

• Use the Site in any way that violates applicable federal, state, or local laws
• Attempt to gain unauthorized access to the Site, its servers, or any connected system
• Use bots, scrapers, or automated tools to access, copy, or collect content or data from the Site
• Interfere with the proper functioning or security of the Site
• Submit false, misleading, or fraudulent information, including during checkout

We may suspend or restrict access to the Site for anyone who breaches these Terms.

3. Customer Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at playtime@thesupportcare.com if you suspect unauthorized use. We may suspend or close accounts involved in fraud, abuse, or breaches of these Terms.

4. Products and Availability

PLAYTIME sells toys and games for children. Products are presented with their key characteristics, availability status, and prices. Product images are illustrative; minor variations in color, finish, packaging, or design may occur. All offers are valid while supplies last. If a product becomes unavailable after your order, we will notify you within 48 hours and offer either an equivalent substitute or a full refund. We may modify our catalog at any time without prior notice.

5. Product Safety

Each product displays a manufacturer-recommended age range and, where applicable, the safety warnings required by US law. You are responsible for choosing products suited to the age and abilities of the child who will use them and for following all instructions and warnings. 6. Orders

A sales contract is concluded when you receive our order confirmation email. Requests to modify or cancel an order must be sent to playtime@thesupportcare.com within 2 hours of placing it. We may refuse or cancel an order, in whole or in part, in case of suspected fraud, resale activity, an obvious pricing or listing error, or insufficient stock. In each of these cases, you are refunded in full.

7. Pricing and Promotions

All prices are displayed in US Dollars (USD) and include applicable federal and state taxes where required by law. Shipping fees are calculated separately at checkout. Where a compare-at price is shown, it refers to a price at which the product has previously been offered for sale. Products are billed at the price in effect when the order is confirmed. We reserve the right to cancel and refund any order affected by an obvious pricing error. Promotions are valid only for their stated duration, cannot be combined unless expressly stated, and have no cash value.

8. Payment

We accept Visa, Mastercard, and American Express via SSL-secured payment, as well as bank transfer. Full payment is due when the order is placed. You are charged in the currency displayed at checkout and confirm that you are authorized to use the payment method provided.

9. Delivery

Delivery terms are described in our Shipping Policy. Risk of loss passes to you upon delivery; title passes to you upon receipt of full payment.

10. Warranty and Returns

All products conform to their descriptions and are free from defects at the time of delivery, and are covered by a manufacturer's warranty, in addition to your rights under applicable consumer protection laws. Returns and refunds are handled as described in our Refund Policy.

11. Intellectual Property

All content on the Site, including texts, images, logos, graphics, videos, and layout, is the exclusive property of PLAYTIME LLC and is protected by US and international intellectual property laws. No content may be reproduced or used without our prior written authorization. Creating hyperlinks to the Site requires our prior written consent.

12. Third-Party Links and Services

The Site may contain links to third-party websites. We have no control over them and accept no responsibility for their content, availability, or privacy practices.

13. Disclaimer

We make every effort to ensure the accuracy of the information on the Site, including product descriptions, pricing, and availability, but cannot guarantee it is always error-free or up to date. The Site is provided "as is" and "as available", and we do not guarantee uninterrupted access. We are not responsible for disruptions affecting the Internet or third-party services.

14. Limitation of Liability

To the fullest extent permitted by law, PLAYTIME shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or misuse of the Site or of products purchased through it, including damages resulting from failure to follow product instructions, warnings, or age recommendations. Our total liability for any claim related to an order shall not exceed the amount paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless PLAYTIME LLC, its managers, employees, and partners from any claim, loss, or expense, including reasonable attorneys' fees, arising from your breach of these Terms or misuse of the Site.

16. Dispute Resolution

In the event of a dispute, you agree to first contact playtime@thesupportcare.com to seek an amicable resolution. If no resolution is reached, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), with proceedings conducted in Chicago, Illinois. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

17. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Subject to Section 16, any legal action shall be brought exclusively in the courts of Cook County, Illinois.

18. Changes to These Terms

We may modify these Terms at any time. The version in force on the date of your order applies to that order.

19. Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies referenced in Section 1, constitute the entire agreement between you and PLAYTIME regarding the Site.
